Terms of Service

These Terms of Service ("Terms") govern your access to and use of Race Simple ("the Service"), operated by Race Simple ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Race Simple is a motorsport part-life tracking platform that enables teams to manage vehicle templates, track component service intervals, log events and mileage, and monitor remaining part life across a fleet. The Service is provided on a subscription or trial basis as described on our website.

2. Accounts and Teams

• You must authenticate via a supported identity provider (Google or Microsoft) to access the Service.
• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
• Teams are the primary organisational unit. A team owner is responsible for managing membership and ensuring all team members comply with these Terms.
• You must provide accurate information and promptly update it if it changes.
• You may not share your account credentials or allow others to access the Service using your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Service, its infrastructure, or other users' data.
• Introduce malicious code, conduct denial-of-service attacks, or otherwise interfere with the Service's operation.
• Scrape, reverse-engineer, or reproduce any part of the Service without our express written consent.
• Resell or sub-license access to the Service without our prior written approval.

4. Your Data

You retain ownership of all data you input into Race Simple (vehicle data, service records, templates, etc.). By using the Service, you grant us a limited licence to store, process, and display your data solely to provide and improve the Service. We do not claim any intellectual property rights over your data.

You are responsible for the accuracy and legality of the data you input. We do not verify the correctness of service intervals, mileage figures, or safety data you enter.

5. Intellectual Property

All software, design, trademarks, and content comprising the Race Simple platform (excluding your data) are our exclusive property or are licensed to us. You may not use our name, logo, or branding without prior written consent.

6. No Safety Warranty

Race Simple is a data management and tracking tool only. It does not constitute engineering advice, safety certification, or a substitute for qualified inspection of motorsport components. We expressly disclaim any liability for decisions made on the basis of data recorded in the Service. You are solely responsible for the safety of your vehicles and personnel.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Service will be error-free or that data will never be lost.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Race Simple be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amounts paid by you for the Service in the twelve months preceding the claim.

9. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access at our discretion if you breach these Terms or engage in activity that we reasonably believe is harmful to the Service or other users. On termination, your right to access the Service ceases; data may be retained for a period as described in our Privacy Policy before deletion.

10. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes to the Terms will be communicated with reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
